Bennington Hospital Settles Lawsuit Involving Missing Records

Sep 28, 2004 | AP Southwestern Vermont Medical Center has settled a lawsuit charging that it lost records involving a severely brain-damaged baby.

Leo and Julie Gauthier of Hoosick Falls, New York, sued the hospital three years ago, accusing the hospital and Dr. Ellen Biggers of medical malpractice.

They alleged that Biggers failed to properly monitor the heartbeat of their son when he was delivered and did not respond to signs of fetal distress.

The hospital was unable to produce fetal monitoring strips for the six hours before the boy was born. Those strips would be critical to understanding why he was injured.

The terms of the settlement have not been released.
