Former Patient Has Filed A Federal Lawsuit Against The American Red Cross And The Hospital.

A former patient at a Umatilla County hospital has filed a federal lawsuit against the American Red Cross and the hospital claiming she contracted hepatitis C after receiving a blood transfusion during an operation in July 2002.

Elizabeth Moore, 64, of Hermiston continues to receive treatment for the illness, said her attorney.

Moore has a type of hepatitis that is "most resistant to treatment." According to her lawsuit, Moore has spent $50,000 on treatment.

The Suit Names Good Shepherd Community Hospital As a Defendant.

In addition to the American Red Cross, the suit names Good Shepherd Community Hospital as a defendant. Attorneys for the Red Cross and the hospital did not return phone messages.

Moore had a hysterectomy and required a second surgery. It was during the second procedure that she was given four units of blood. The four donors linked to those units of blood tested negative for the disease, which attacks the liver.

The Red Cross, after learning of Moore's condition, followed up with three of the four blood donors and found they were clear of the disease. The Red Cross could not locate the fourth donor for follow-up testing.

In her suit, Moore accuses the hospital and the Red Cross of negligence for failing to screen the blood, store it properly or keep adequate records.
