Volga Couple Awarded $1.7 Million In Malpractice Suit

May 7, 2004 | AP

A Volga couple has been awarded $1.7 million in a malpractice suit against a former Brookings doctor.

Lanita and Lyle Arndt sued Oldrich Bubenik, a surgeon who practiced in Brookings from 2000 to 2002, based on a surgery he performed on Lanita Arndt.

She was diagnosed with a twisted colon and had to have part of her colon removed at a Brookings hospital in September 2001.

The plaintiffs contended the doctor reattached the colon, which fell apart in less than 24 hours and caused a severe infection. They also said he mismanaged the woman's care while she was hospitalized in Brookings.

The woman was later transferred to a Sioux Falls hospital and underwent another surgery, said Russell Janklow, a lawyer for the Arndts.

Lawyers for the defendant could not be reached for comment.

A U.S. District Court jury deliberated six hours before returning the verdict April 30.

The average medical malpractice payment in South Dakota in 2002 was $148,120, according to the National Practitioner Data Bank.
