Update on the Metal-on-Metal DePuy Hip Replacement Implant Litigation

In re: DePuy Orthopaedics, Inc. ASR Hip Implant Products Liability Litigation (“MDL No. 2197″), is pending in the U.S. District Court for the Northern District of Ohio.
The depositions of Dr. Thomas Vail, who developed the recalled hip replacement, and of several company executives were recently noticed in the federal DePuy ASR litigation, including: the Group Manager, Global Testing & Simulation; the Senior Bioengineer; and the Product Director of Hip Marketing. These depositions are scheduled for May and June 2012.
These upcoming depositions of DePuy Orthopaedic executives as well as one of the developers of the recalled hip replacement will cover many topics including: designing, selling, promoting and marketing of the ASR hip implants, as well as communications relating to problems with the device, post market surveillance and the eventual recall of the devices. The DePuy executives have also been asked to produce documents such as, notes, outlines, presentation materials, testimonies and oral proposals either prepared by or given to them that relate to or discuss the recalled hip replacement systems.
Latest case update: A status conference in the federal DePuy ASR litigation is scheduled for May 1, 2012, at 11:30 a.m. The conference will take place at Paul G. Rogers Federal Building and United States Courthouse in West Palm Beach, Florida. Shortly after, an open court conference will begin at 12:30 p.m. on that same day.
