If you’ve been involved in a car accident, whether you are the driver or a passenger, you may be asked to attend a deposition. Depositions are one of the beginning steps in the litigation process as someone has brought a lawsuit against another person or company.
Depositions are basically a question and answer session in which attorneys from both sides of a lawsuit asks questions of all parties involved. As a passenger in the car during the accident, your answers will serve as testimony. This information is used throughout the lawsuit process to help determine who is at fault.
What questions you will be asked during this deposition vary based on what type of case it is. With a car accident case, the questions are going to revolve around what happened before, during, and after the accident. You’ll be asked if you know how fast the car was traveling, what direction you were traveling in, and when you first saw the other vehicle involved in the accident. The questions will continue to ask about where the accident occurred and what was going on such as what color was the traffic light, were either cars making a turn, or did you notice any defects in the street like a pothole? Your answers will be a part of an entire investigation into who was at fault for the accident. Once all the parties involved are questioned, the attorneys will try to construct how the accident happened and show who is at fault. If they are unable to resolve the situation before trial, you may be asked to answer your questions again in front of a jury. Watch the video now to learn more.
