Gentek Building Products has produced vinyl, aluminum and steel siding for more than 40 years. According to the Gentek class action lawsuit, the siding at the center of the complaint is warranted against cracking, chipping, flaking, peeling or splitting, as well as certain other manufacturing defects, for the life of the individual purchaser. If a property is sold, the Gentek siding warranty is transferred to the new owner, and is in effect for 50 years after the original installation. Finally, the warranty extends for 50 years when a purchaser is a government or corporate entity.
The Gentek siding class action lawsuit claims that the siding at issue is inherently defective because it begins to peel, chip and crack within the original warranty period. Other homeowners have reported an inconsistency in paint color, with the paint’s appearance changing once it’s been exposed to several years of sunlight.
Gentek is obligated by the specific terms of the warranty to either repair, replace or in the case of siding sold in 1995 and thereafter, refinish the siding.
