NEW YORK, NY- Qchron.com reports that an ATV rider is facing murder charges for killing a cyclist in Ridgewood last August.
The ATV rider, Sean Martin, 24, is from Ozone Park. Martin was riding an ATV, or all-terrain vehicle when he struck the victim’s bike in a maneuver known as a “kick out.” The victim, 65-year-old Eucario Xelo was biking home from his job as a dishwasher when he was attacked. Xelo was at the intersection of Woodbine Street and Seneca Avenue when he was struck from behind at about 1 in the morning.
The move involved having the back tires of the ATV strike the back of Xelo’s bike. Xelo fell and hit his head on the street. Xelo was transported to the Elmhurst Hospital where he died from his injuries a few days after the attack.
After attacking Xelo, Martin left the scene and went on to attack another cyclist. A surveillance video shows the ATV rider riding up to another bike. The other cyclist was able to evade the attack by swerving.
The District Attorney, Richard Brown, called Martin’s attack an “egregious and senseless act of depravity,” and stated that the victim took steps to stay safe by wearing reflective clothing, but his precautions did not help because he was intentionally attacked.
Martin is now facing charges for “second-degree murder, first-degree assault, first- and – second-degree manslaughter, first-degree attempted assault, first-degree reckless endangerment, third-degree criminal possession of a weapon and leaving the scene of an accident without reporting.” Martin could be facing as many as 25 years in prison.
Xelo had five children and eight grandchildren. A GoFundMe page has been set up to help Xelo’s family with funeral expenses.
