Costco customers may have been deceived into believing they purchased a Tiffany ring. On February 14, 2013, Tiffany & Co. filed a trademark lawsuit in Federal District Court in Manhattan alleging that it had sold diamond engagement rings falsely marketed as Tiffany. According to the suit, Tiffany received a complaint from a customer who said “that she was disappointed to observe that Costco was offering for sale what were promoted on in-store signs as Tiffany diamond engagement rings.” The lawsuit states that after further investigation, Tiffany found that rings advertised as Tiffany were in fact not Tiffany rings. The company says it confronted Costco, who subsequently said that it removed all references to Tiffany from its signage. The suit alleges that “Unbeknownst to Tiffany, Costco had apparently been selling different styles of rings for many years that it has falsely identified on in-store signage as ‘Tiffany.’”
Tiffany states that Costco salespeople would refer to rings as Tiffany, but were not advertised as such online, thereby avoiding detection of their illegal activity. The jeweler stated that “Tiffany has never sold nor would it ever sell its fine jewelry through an off-price warehouse retailer like Costco.” Due to this deception, the lawsuit says, “hundreds if not thousands of people who mistakenly believe they purchased and own a Tiffany engagement ring from Costco.” Tiffany has asked for all profits made from selling the rings as well as additional damages.
