Sloan Valve Co.'s CSPC Flushmate III Recall

According to the Consumer Products Safety Commission (CPSC), there have been 304 reports of exploding toilets resulting in property damage in connection with the Series 503 Flushmate III Pressure-Assist Flushing System.  At least 14 consumers sustained laceration injuries in these exploding toilet incidents.  According to the Commission, the Flushmate system can burst at or near the vessel weld seam releasing stored pressure. This pressure can lift the toilet tank lid and shatter the tank, posing impact or laceration hazards to consumers and property damage.

The reports of exploding toilets associated with the Flushmate III system prompted the CPSC to order a recall for more than 2 million units in the U.S.  The affected Flushmate III units were manufactured from October 1997 to February 2008, and consist of rectangular, black, two-piece vessels made of injection molded plastic. The recalled Flushmate III units can be identified by a 16-character date code/serial number located on the label on the top of the Flushmate III. The first six numerals of the serial number are the date code. The date code range for this recall begins with 101497 (October 14, 1997) and continues through 022908 (February 29, 2008).  The recalled units were sold at Home Depot and Lowe's stores, distributors and plumbing contractors nationwide for about $108.  The recalled Flushmate III systems were also sold to toilet manufacturers including American Standard, Crane, Eljer, Gerber, Kohler, Mansfield and St. Thomas.

Consumers who have the affected Flushmate III system installed in their toilet should turn off the water to the toilet and stop using it immediately.  Flushmate has offered a free repair kit, but a consumer in a class action lawsuit has alleged that the kit is not adequate to fix the problem, and claims the entire flushing systems requires replacement by a professional plumber.  The Flushmate exploding toilet lawsuit also alleges that Flushmate became aware of the Flushmate System defect as early as June 2000 but continued to sell the system without disclosing the defect or risk to consumers.   The lawsuit further alleges that Flushmate has continued to downplay the risk, despite receiving hundreds of reports of the exploding toilets and at least 14 reports of serious injuries.
