Lawsuit for Consumers Mislead by Savings Claim

If you purchased so-called energy efficient replacement windows for your home, you may have a potential legal claim against the manufacturer of your windows. In August 2012, the U.S. Federal Trade Commission (FTC) warned 14 window manufacturers that they could be violating the law by making unsupported energy savings claims for their replacement windows.

Energy Efficient Replacement Windows
West Window Corp., Acadia Window Corp. and the other replacement window manufacturers named below have made claims that consumers will save more than 30% on their energy or heating and cooling bills by installing their replacement windows. According to warning letters issued to all of the companies, the FTC had reviewed their websites and found that their claims might violate the law. Some of the statements cited by the FTC letters included:
"Energy efficient windows can help you save a bundle. In fact, you can reduce your energy bills by one-third by simply using low-emissivity glass." - West Window Corp.
"By replacing old wood or aluminum windows with energy efficient Acadia windows, many of our customers have reported energy savings of 40% or more." - Acadia Window Corp.
“Our windows could add overall value to your home while cutting your energy costs by more than 43%." -
Nationwide Window & Siding Corp.
The FTC strongly urged the 14 companies to review their marketing materials, and reminded the firms that such claims must be backed-up by scientific evidence. According to the letters, all of the claims questioned by the FTC were similar to those challenged in administrative complaints the Commission filed earlier in the year against five other companies. All of those companies - Gorell Enterprises, Inc.; Long Fence & Home, LLP; Serious Energy, Inc.; THV Holdings LLC; and Winchester Industries - agreed to orders barring them from making exaggerated and unsupported claims about their windows’ energy efficiency and how much money consumers could save on their energy or heating and cooling bills by having them installed.
