New York Window Washing Law

Section 202 of the New York Labor Law, also known as the New York Window Washing Law, requires the owner, lessee, agent and manager of every public building to abide by the state's Industrial Code to provide safe means for the cleaning of the windows and exterior surface of the building. Under the statute, these parties must take measures that allow window washers to work safely. Among other things, they must ensure that a building is fitted with structural features, anchors or other fixed devices for the window washer's protection. According to the New York Window Washing law, window washers should not even be permitted to clean unless proper protection is provided. In order to impose liability, an injured window washer must establish that there was a violation of a standard of New York’s Industrial Code, which provides special regulations to protect persons employed in construction, demolition and excavation operation. It should be noted, however, that Section 202 does not impose absolute liability on owners, lessees, agents and managers, which means these parties can escape liability if a worker is shown to have been negligent. As such, the New York Window Washing Law imposes obligations on workers to use any safety devices provided.
