Consumers rely on manufacturers and producers to provide products that are safe, durable, and will function as intended. Cars, appliances, tools, toys, medicines and other products generally meet expectations. Sometimes, however, products that are brought to the marketplace are defective. Unfortunately, defective products are the cause of many injuries and illnesses.

There are many reasons why products may fail. Examples include: poor design, inferior or tainted materials, a questionable manufacturing process or inadequate quality control.

One type of product that might be the cause of many injuries, if defectively manufactured, is medication. An improperly manufactured drug can contain too much or too little of the active ingredient and will not work as intended. Labels and package inserts sometimes fail to give adequate instructions for proper administration of the medicine or do not adequately warn the user about possible side effects and interactions, leaving the consumer at risk. In 2012 and 2013, a multistate fungal meningitis outbreak caused by contaminated steroid injections sickened more than 700 people and caused 64 deaths, according to the Centers for Disease Control and Prevention. The injections had not been manufactured under sterile conditions.

Defective medical devices, especially devices implanted in the body, are a potentially serious danger to consumers. Patients implanted with defective devices can suffer significant pain and injury, may sometimes require additional surgeries to correct the problem, or worse, death.

Parker Waichman is nationally known for representing people injured by defective drugs and defective medical devices. Parker Waichman advises anyone who is injured by a dangerous or defective product to contact an attorney to determine what legal recourse they may have.
