A recent businessinsider.com article tells the tragic story of a man who sustained a severe spinal cord and brain injuries in a motor vehicle accident caused by an Amazon van. The accident victim’s lawsuit alleged that Amazon’s surveillance technology could push its drivers to rush deliveries, causing traffic accidents.
According to an Amazon spokesperson, the company denied liability in the delivery van accident since Amazon does not hire its drivers directly. However, the victim’s lawsuit argues that Amazon is liable since the delivery drivers use the company’s driver surveillance system inside their delivery vehicles. Amazon’s attorneys stated that the company contracts with independent delivery companies called Delivery Service Partners.
The accident victim’s attorney argued that Amazon’s delivery vehicle monitoring technology is a danger to motorists on public roadways because the system pushes delivery drivers to hurry their deliveries to the point it is unsafe. The personal injury lawsuit also contends that when an Amazon driver is behind schedule, the delivery driver receives critical messages from Amazon. The Amazon delivery truck accident lawsuit also blames the Amazon contractor for speeding prior to the crash.
Amazon drivers and Delivery Service Partners have issued complaints about the pace at which Amazon demands them to make deliveries. Amazon’s current monitoring system monitors the drivers through an app and provides the drivers with a score based on the driver driving. The Amazon delivery drivers are also monitored by AI-powered cameras that are inside the delivery vans.
According to one University of Miami Law Professor, Andrew Elmore, Amazon is vicariously liable for the crash as an employer because of the amount of control the company has over the delivery driver. The legal case shines a new light on Amazon’s driver monitoring systems. Amazon asked the court to seal information concerning its safety technology citing that its technology qualifies as a trade secret.
