
Auto recall accident lawsuit
A news report posted on jalopnik.com, a Ford Dealership is under federal investigation after allegedly selling a motor vehicle with an open safety recall. The motor vehicle was one of the thousands Ford Motors recalled due to a dangerous leaky fuel tank defect. National Traffic Highway Safety officials stated that its investigation concerns a New York state Ford dealer that allegedly sold a new car that had an open recall, violating federal law.
According to NADA (National Automobile Dealers Association), recalled motor vehicles must be placed on a “stop sale” until the issue is fixed. Moreover, vehicles with unrepaired recalls cannot be sold or delivered until the issue has been fixed.
The National Traffic Highway Safety stated that they had received a tip concerning the sale of a brand new 2021 Escape and that vehicle had an open recall. Ford Motors issued a recall bulletin to all Ford dealerships concerning its Escape and Lincoln Corsair back on August 11, 2021. This recall affects about 14,000 vehicles that may have a faulty fuel delivery module in the fuel tank, causing a dangerous fuel leak. The leak could cause the engine to stall out.
Karl Henkel, a Ford spokesperson, expressed in a statement that the dealer should have been aware of the NHTSA’s audit inquiry, and Ford Motors is cooperating with the NHTSA’s investigation. Although Ford dealerships are independently owned, Ford reports all recalls to dealerships and customers as mandated by NHTSA.
NHTSA investigators are also investigating whether or not the Ford dealership complied with the National Traffic and Motor Vehicle Safety Act. The act orders automakers to issue recalls as soon as dangerous defects are discovered and grants the federal government authority to intercede when recalls aren’t initiated timely. The NHTSA is also investigating whether or not the Ford dealership sold additional vehicles with open recalls.
