Figuring out who is at fault for an auto accident in New York is difficult. Usually, no party is solely responsible. Many car accidents involve a gray area or a level of uncertainty. The question of fault then maybe resolved by a judge or a jury in favor of the more credible witness. Some car accident investigations may reveal objective evidence such as a surveillance video or the police have recovered the event data recorder from the car. A third-party, who is an unbiased witness, can provide information as well that could help one side or another.
In auto accidents in New York, the injured victim can recover monetary damages even though he or she might have contributed to causing the accident. In the State of New York, the courts apply the comparative negligence standard to car crash injury cases. The legal doctrine of comparative negligence allows the injured party to receive compensation even though some percentage of the accident is attributable to him or her. However, the judge will instruct the jury to reduce its award by the portion of the fault it assigns to the plaintiff. Therefore, having the right lawyer on your side fighting to protect your rights in a New York auto collision is vital to the success of your claim.
