Mirena IUD caused uterine perforations and other injures are continuing to mount. Parker Waichman LLP, a national law firm dedicated to protecting the legal rights of people injured by defective medical devices, reports that personal injury lawsuits alleging the Mirena IUD caused uterine perforations and other injures are continuing to mount, with a total of 16 cases filed so far in New Jersey Superior Court, Morris County.
In anticipation of a large and growing number of cases, Bayer HealthCare Pharmaceuticals, Inc., the maker of the Mirena IUD, is seeking centralized management of the Mirena IUD lawsuits in Middlesex County.
Parker Waichman LLP is already representing several young women who suffered uterine perforations allegedly due to the Mirena IUD in lawsuits pending in Morris County, including three complaints filed since May (Case Nos. MRS-L 001910-12, MRS-L 924-12, and MRS-L 1263-12).
According to the lawsuits, the Mirena IUD was approved by the U.S. Food & Drug Administration (FDA) in 2000, and is currently used by 2 million women in the U.S. Globally, more than 15 million women have used Mirena. The device is inserted into the uterus within seven days of the first day of menstruation, where it releases the synthetic progestin, levonorgestrel, directly into the uterus. The Mirena IUD may remain for up to five years.
According to the Mirena has been associated with a number of serious side effects
According to the FDA, Mirena has been associated with a number of serious side effects, including:
- Perforation of the uterine wall or cervix
- Embedment of the device in the uterine wall
- Ectopic pregnancy
- Intrauterine pregnancy (a pregnancy with Mirena in place)
- Group A streptococcal sepsis
- Pelvic inflammatory disease
All of the lawsuits allege the Mirena IUD caused users to suffer severe and permanent physical injuries and substantial pain and suffering. The complaints further allege that Bayer and other Defendants have a history of overstating the benefits of the Mirena IUD, and understating its potential complications.
The complaints point out that in 2009, the Department of Health and Human Services’ Division of Drug Marketing, Advertising, and Communications (DDMAC) found that claims made via Bayer’s “Simple Style Program” which marketed Mirena to “busy moms,” were unsubstantiated, noting that the program failed to mention side effects such as weight gain, acne and breast tenderness.
