CHARLOTTE COUNTY, FL. — A Punta Gorda man hit by a car has died. WINKNEWS.com reported that the man was hit from behind by a vehicle on U.S. 41 on Saturday, September 22, 2018. Troopers from the Florida State Patrol and other law enforcement agencies have not determined whether the motorist who struck the pedestrian will face any charges and the matter remains under investigation.
WINK News reports that a pedestrian walking southerly in the “outside” lane of U.S. 41 just north of Oil Well Road. That pedestrian, subsequently identified by police as 33-year-old Allen Michael Walsh of Punta Gorda, was not on the sidewalk when struck. Instead, the information provided seems to suggest he was walking within the lane of travel.
The investigators say that the operator of a Lincoln Continental was driving in the same lane as Mr. Allen when the Continental struck him from behind. Authorities said that the impact flipped Mr. Allen in the air. He went over the hood of the Lincoln and landed on the rear windshield.
Authorities did not state whether first responders declare Mr. Allen deceased at the scene or after transport to a local trauma center.
Investigators from the Florida Highway Patrol did not identify the operator of the Lincoln. They have not stated whether the driving will face possible criminal or civil sanctions as a result of the fatality.
The investigation could center on why the motorist did not see the pedestrian occupying the same lane as the vehicle. The time of the crash was not given so lighting could be a factor in the outcome of the investigation. Additionally, police will examine if the operator of the Continental was distracted by any devices or operating while under the influence of alcohol or narcotic. The same may be said for the pedestrian. Blood tests from an autopsy performed on Mr. Allen could inform investigators whether alcohol or drugs influenced his decision to walk in the road.
