Numerous claims and lawsuits have been filed against Merck & Co., Inc. and its subsidiary, Merck Sharp & Dohme Corp., (“Merck”) nationwide alleging injuries caused by the Gardasil® human papillomavirus (HPV) vaccine. These cases similarly allege that the vaccine has caused countless individuals to develop serious health problems, including, without limitation, infertility and seizure disorders. Despite having been approved by the Federal Food & Drug Administration (FDA) back in 2006, people continue to be harmed by the vaccine, leading to the thousands of lawsuits and claims that have been brought against Merck.
Over the past few years, Merck has aggressively marketed its vaccine – Gardasil – urging American families to vaccinate girls and boys between the ages of 9 and 26. In its fear-inducing campaign, Merck promised to provide them with lifelong protection from developing HPV, a sexually transmitted disease that can lead to the development of cervical cancer in women. There are a number of different strains of HPV, however, Gardasil offers protection against cervical cancer for four of them.
According to recent investigations, Gardasil, once marketed as a nearly side effect free vaccine by Merck, has been associated with severe side effects, including, without limitation, seizure disorders and infertility. These investigations reveal that the FDA has erred in its approval of Gardasil in failing to sufficiently examine the results from Gardasil’s clinical trials. Meaning, the FDA did not properly review the potential complications of the drug, which has been the cause of serious and sometimes fatal side effects being experienced by countless boys and girls in the United States. Presently, several thousand cases of adverse reactions and as many as 8 deaths have been associated with this dangerous drug.
Gardasil’s FDA Approval and Adverse Event Warnings
Merck received FDA’s approval of Gardasil in June of 2006. In seeking approval of the drug, Merck touted it as being 90 to 100% effective in preventing certain strains of HPV that are linked to cervical cancer. Following the FDA’s approval, Merck went so far as to claim that the drug may eliminate most cervical cancers. The manufacturer aggressively lobbied state health authorities across the U.S. for the mandatory vaccination of young girls. As such, the Centers for Disease Control and Prevention (CDC) recommended that the vaccine would be beneficial to be given to girls ages 11 and 12. Overall, the aggressive promotion of the drug in addition to intense lobbying has brought about $1.4 billion into Merck’s coffers.
Despite the dangerous complications associated with Gardasil, the FDA maintains its stance on the vaccine as being a safe and effective treatment. According to the FDW, “ased on the review of available information by FDA and CDC, Gardasil continues to be safe and effective, and its benefits continue to outweigh its risks. CDC has not changed its recommendations for use of Gardasil. FDA has not made any changes to the prescribing information for how the vaccine is used. In addition, FDA routinely reviews manufacturing information, and has not identified any issues affecting the safety, purity and potency of Gardasil.”
Notwithstanding, the FDA further provides that it encourages the use of Gardasil, asserting that it is a safe and effective vaccine that has the potential to benefit millions of women and men in the prevention of the dangerous strains of HPV. However, it is important to note that according to the National Cancer Institute’s Surveillance, Epidemiology and End Results Program, the incidence of deaths from cervical cancer prior to the introduction of Gardasil in the U.S. market was on a steady decline with a rate of 2.4 per 100,000 women.
Due to the numerous adverse effects associated with the use of Gardasil, multiple lawsuits have been filed against Merck. Their allegations assert, among others claims, that Merck:
In many of the lawsuits, parents assert that their kids were healthy and happy before having been administered the vaccine, and as a result, continue to suffer serious and ever-worsening health issues.
In one such lawsuit, a 21-year-old man, formerly an active kid who loved the outdoors, excelled in school, and ran cross-country, became debilitated and disabled at the age of 14 due to being administered the Gardasil vaccine. His complaint accuses Merck of negligence, failing to warn of the hazardous side effects associated with the drug, and of manufacturing defects.
The attorneys representing the man are also seeking punitive damages due to the fact that Merck allegedly made the conscious decision to not inform consumers about the adverse health risks associated with the vaccine. Specifically, the lawyers assert that Merck put profits over patient safety and now many children and adults are facing serious and even fatal health issues.
In another lawsuit, a 12-year-old girl received the Gardasil vaccine, where at the time, she was a happy, physically active, and talented girl who enjoyed art and music. Like countless other mothers across the United States, the child’s mother allowed her daughter to be vaccinated with the drug due to the numerous television, internet, and in-print advertisements urging parents to give their children the Gardasil vaccine.
According to the lawsuit, these ads touted the vaccine as safe and effective in preventing HPV. Within 24 hours of being given the vaccine, the girl experienced life-threatening complications, including seizures, face swelling, slurred speech, and a severe headache. Per the complaint, it alleges, among other claims, that the HPV vaccination contains several dangerous ingredients, one of which the manufacturer intentionally failed to disclose to the public as well as regulators.
One ingredient, Polysorbate 80, is associated with numerous adverse health effects. As a result of the aforementioned, the girl health has been irreparably affected for the remainder of her life.
