Weight Pocket Handle Failure in Buoyancy Devices Poses Potential Danger to Divers
Huish has issued a recall of its Oceanic brand SCUBA Diving Buoyancy Compensating Devices due to a potential drowning threat. The subject models under this recall are the Oceanic OceanPro, Oceanic Excursion, and Oceanic Hera.
The problem lies in the weight pockets’ handles of the Buoyancy Compensating Devices. These handles can fail under certain conditions. If a handle breaks, the diver may be unable to jettison the weight pockets in emergency situations, potentially causing a drowning risk.
The proposed solution to this problem is to replace the faulty part. The recall was announced on June 15, 2023. The recall covers about 7,100 units sold in the United States and another 345 units sold in Canada.
The recall pertains to SCUBA Diving Buoyancy Compensating Devices (BCD). These jacket-style BCDs, worn during a dive, resemble a vest with an attachment point at the back for the tank. They come with an upper airway assembly composed of a corrugated rubber hose and an inflation mechanism compatible with a SCUBA regulator. The devices also feature integrated weight pouches that can be loaded with weights for dumping in emergencies. Specific serial numbers and QLR4 Pocket Handles without a date code on the underside have been included in the recall.
As a precautionary measure, users should immediately cease using the recalled Buoyancy Compensating Devices and reach out to Huish Outdoors for complimentary replacement weight pockets. These pockets can be easily detached and replaced. Users are advised to discard the current weight pockets.
Thus far, the company has received 73 reports regarding broken weight pocket handles, although no injury has been reported. These devices were available at scuba diving equipment stores nationwide and online through third party distributor and dealer websites from April 2019 through May 2023, with prices ranging from $530 to $720.
The recalled products were imported by Huish Outdoors, based in Salt Lake City, Utah, and manufactured in China and Vietnam. The recall number is 23-222. Families Seek Legal Recourse for Losses
For families who have tragically lost a loved one due to this faulty product, the pathway towards justice and compensation might involve filing a wrongful death claim. Wrongful death claims are legal actions that aim to hold negligent parties accountable when their misconduct or inaction leads to a death.
If a SCUBA diving accident can be traced back to the use of one of these recalled Buoyancy Compensating Devices, and it is established that the failure of the device was a direct cause of the accident, then the grounds for a wrongful death claim could be established. The claim would seek to prove that the malfunctioning device was a direct and proximate cause of the diver’s death.
Filing such a claim could potentially yield compensation for a variety of damages, including but not limited to medical expenses, funeral and burial costs, loss of income, and non-economic damages like loss of companionship or emotional distress. These claims can help provide financial security to the deceased’s family, especially if the deceased was a primary income earner.
However, wrongful death claims can be complex and require careful navigation of the legal system. It is highly recommended for families considering this action to consult with one of our experienced product liability or wrongful death attorney. Our legal professionals can provide guidance on the potential validity of the claim, help gather necessary evidence, and advise on the best course of action.
Even in the tragic event of loss, it’s crucial that companies like Huish are held accountable for their product’s potential failings. A wrongful death claim can serve not only as a means for families to secure deserved compensation, but also as a powerful tool to ensure such tragic incidents are prevented in the future.
