GLENDALE, CALIFORNIA – As reported online by www.latimes.com, a California couple has filed a lawsuit against a fertility clinic, alleging the clinic implanted their embryo into another woman across the country, which resulted in the birth of the couple’s son.
A Glendale couple has filed a lawsuit against a fertility clinic that allegedly had a series of embryo mix-ups. The couple had been trying to get pregnant with in-vitro fertilization (IVF) and had spent more than $100,000 on fertility treatments. The lawsuit alleges that the fertility clinic implanted the Glendale couple’s embryo into another woman in New York. Additionally, the lawsuit alleges that the New York woman was also implanted with a third couple’s embryo, giving birth to another child that was not her own.
The Glendale couple also alleges that they received another couple’s embryo, and implantation did not result in pregnancy. How and why the embryo mix-up happened, which purportedly involved multiple couples, are unclear. The couple also asserts that the mother underwent multiple medical procedures to address precancerous cells that were present following additional IVF treatments, and that such procedures may not have been necessary had there not been a mix-up of embryos.
In addition to holding the fertility clinic accountable for pain and suffering and hefty expenses for its role in the embryo mix-up, the Glendale couple sought to gain custody of their son born to another woman in New York. While the Glendale couple has expressed gratitude to the New York woman (who wanted to maintain custody of the Glendale couple’s son), the Glendale couple proceeded with efforts to gain custody and were successful in doing so. The Glendale couple now has their son with them in California.
