Marketing Claims Settlement. The people behind a heavily advertised dietary supplement called Focus Factor have agreed to a more than $1 million settlement with the government.
Ads from Vital Basics, Inc. of Portland, Maine, promised that Focus Factor could improve a person’s focus, memory, mood and concentration but the Federal Trade Commission said the marketers didn’t have the evidence to back up any of those claims.
The settlement also covers a sister product called V-Factor that supposedly enhanced sexual performance. The FTC says those claims were unsubstantiated as well.
Two companies that were involved in marketing Focus Factor and V-Factor have agreed to pay a total of $1,060,000 to compensate consumers who bought the products. The companies also have pledged not to make similar claims about supplements in the future unless they can offer reliable proof.
