NEW JERSEY- Blog.cvn.com writes that the second Johnson & Johnson talc trial to take place in New Jersey’s closing arguments are scheduled for October 9, 2018. A recent trial involving similar proceedings resulted in a large verdict for the plaintiff. A New Jersey jury ordered Johnson & Johnson to pay a total of $117 million in damages. The award included punitive damages in the amount of $80 million.
The current trial is being closely watched to determine if it will result in a similar verdict. The plaintiff in the current case, Rosalind Henry, was diagnosed with mesothelioma and alleges that she developed the aggressive form of cancer because of exposure to asbestos in Johnson & Johnson products.
Henry’s lawsuit was to be the first case against Colgate to be heard in New Jersey. The lawsuit was also going to be the first to be tried against Johnson & Johnson and Colgate. However, prior to the completion of jury selections, Colgate settled with the plaintiff. Imerys, the company that supplies Johnson & Johnson’s talc, also settled before jury selections were concluded.
Henry’s claims are being heard in close proximity to the Johnson& Johnson headquarters. The trial is expected to be a good indicator for the chances of future success for plaintiffs. The jurisdiction is thought of as defendant-friendly because the company is a major employer in the region.
Other claims involving talc products causing mesothelioma to have been tried in California, South Carolina, and New Jersey. The claims involving mesothelioma from asbestos-contaminated talc-products are different from claims that talc-products cause ovarian cancer in women who use the products for the purposes of feminine hygiene. One ovarian cancer-talc trial resulted in a $4.6 billion verdict for the plaintiffs.
