UNITED STATES – June 25, 2020 – According to a news article posted on NHBR.com, the number of hernia mesh lawsuits filed against Atrium Medical Corporation reach over 2,135 cases. These cases are filed in the U.S. District Court in Concord, New Hampshire. The lawsuits allege that Atrium Medical Corporation manufactured and sold faulty hernia mesh products that cause injury and require corrective surgical procedures.
Each of these hernia mesh lawsuits accuses Atrium’s C-QUR hernia mesh medical devices contain a special coating and solution which causes injury and serious complications. The lawsuits allege the solution contains fish oil, which is one of the key causes of the complications. The lawsuits also claim the plastic mesh itself causes severe complications.
In 2011, Atrium was acquired by Maquet Cardiovascular, a Getinge subsidiary, for $680 million. Both corporations were named in the initial lawsuit, but the hernia mesh plaintiffs withdrew Getinge after the company agreed to a confidential settlement. After many years of discovery, the litigants entering into the settlement phase of the lawsuit. August 2, 2020 is the deadline for the parties to reach a settlement agreement. The trial is set for September. Atrium wanted to push the trial back into January 2021 due to the difficulty of conducting depositions while the coronavirus lockdowns have been in effect. However, the judge ruled mostly in the plaintiffs’ favor.
