The U.S. Consumer Product Safety Commission (CPSC) just announced that four major sellers are issuing voluntary recalls of Nap Nanny® infant recliners.

According to NASDAQ, the move was made when a recall plan could not be reached with the maker of Nap Nanny® infant recliners. This, following a number of infant deaths associated with the dangerous products. Amazon.com Inc., Bed Bath & Beyond Inc.’s Buy Buy Baby, Quidsi Inc.’s Diapers.com, and Toys “R” Us and Babies “R” Us agreed to issue the recalls at the request of the CPSC, said NASDAQ.

As we previously wrote, CPSC staff filed an administrative complaint against Baby Matters, LLC, of Berwyn, Pennsylvania, the manufacturer of the Nap Nanny® and Nap Nanny Chill™ infant recliners. The move was made, said the Commission, in an effort to prevent any more children from suffering further harm and following reports of five infant deaths. The CPSC said it is aware of four infants who died in Nap Nanny® Generation Two recliners; a fifth death involved the Chill™ model. To date, the CPSC has received a total of over 70 additional incident reports of children nearly falling out of the Nap Nanny® and Nap Nanny Chill™ infant recliners. The staff alleges that the Nap Nanny® and Nap Nanny Chill™ infant recliners create a substantial risk of injury to the public.

The CPSC notified all retailers of action, but the lawsuit did not mandate any seller to pull the recliners from store shelves, said NASDAQ. The just-announced recalls will accept customer recliner returns; the CPSC advised consumers to contact retailers directly. The recall includes the Nap Nanny® Generations One and Two, and the Chill™ models.

Leslie Gudel, Nap Nanny’s® owner and founder, disputes the Commission’s allegations, arguing that the product is safe when used correctly–on the floor and using a harness. Gudel also said Nap Nanny® went out of business two months ago over its “ongoing battle” with the CPSC, said NASDAQ. Meanwhile, the CPSC warns parents and caregivers that these baby recliners contain defects in the design, warnings, and instructions, which pose a substantial risk of injury and death to infants.

The Nap Nanny is a portable infant recliner designed for sleeping, resting and playing. The recliner includes a bucket seat shaped foam base and a fitted fabric cover with a three point harness. Five thousand Nap Nanny® Generation One and 50,000 Generation Two models were sold between 2009 and early 2012 and have been discontinued. One hundred thousand Chill Models™ have been sold since January 2011. The recalled Nap Nanny recliners were sold at toy and children’s retail stores nationwide and online, including at www.napnanny.com. All models were priced at around $130. In July 2010, CPSC and Baby Matters, LLC issued a joint recall news release to announce that the firm was providing an $80 coupon to Generation One owners toward the purchase of a newer model and improved instructions and warnings to consumers who owned the Generation Two model of Nap Nanny®  recliners. At the time of the July 2010 recall, the CPSC was aware of one death that had occurred in a Nap Nanny® recliner and 22 reports of infants hanging or falling out over the side of the Nap Nanny® even though most of those infants had been placed in the harness. Despite the improvements to the warnings and instructions, the complaint alleges that additional deaths using Nap Nanny® recliners have been reported, which included one instance involving a Chill™ model.
