Four recalls of <"https://www.yourlawyer.com/practice_areas/product_liability">children’s jackets with dangerous drawstrings have been implemented, the U.S. Consumer Product Safety Commission (CPSC) just announced. In all the cases, the recalls were initiated because the children’s jackets have drawstrings through the hood, which can pose a strangulation hazard to children. In every case, the CPSC is advising consumers to immediately remove the drawstrings from the sweatshirts to eliminate the hazard.
Fourteen years ago, the CPSC issued guidelines to help prevent children from strangling or becoming entangled on the neck and waist by drawstrings in upper garments, such as jackets and sweatshirts. In 1997, industry adopted a voluntary standard for drawstrings that incorporated these guidelines. In May 2006, the CPSC’s Office of Compliance issued an announcement that such outerwear with drawstrings at the hood or neck would be regarded as both defective and a substantial risk of injury to young children. Unfortunately, the CPSC guidelines are routinely ignored by the clothing industry, and that attitude has had deadly consequences for some children. From January 1985 through January 1999, the CPSC received reports of 22 deaths and 48 non-fatal entanglement incidents involving drawstrings on children’s clothing.
To date, no incidents or injuries have been reported in any of these specific cases. In every case, the recalled hooded sweatshirts were manufactured in China with the exception of the Weeplay Kids Hooded Sweatshirts, which were manufactured in China and Pakistan. China is a country long associated with products that have been found to be dangerous and linked to an increasing and significant string of recalls.
Baycreek Children’s Hooded Sweatshirts with Drawstrings
About 1,900 Baycreek Hooded Sweatshirts, distributed by Baycreek Inc., of New York, New York were recalled and includes Attitude Gold children’s hooded sweatshirts in sizes small, medium, large, and extra large. The sweatshirts were sold in beige, blue, charcoal gray, and black and have a random distress design. Style number ZZJ-2J, ZZJ-01J, ZZJ-04J, or ZZJ-5J is printed on the hangtag. The recalled Baycreek Hooded Sweatshirts were sold at Burlington Coat Factory and Modecraft Fashions stores nationwide from October 2008 through June 2009 for about $25. The garment can be returned to the place of purchase or to Baycreek for a full refund. Bobens Trading Girls’ Hooded Sweatshirts With Drawstrings
About 3,900 Bobens Trading Girl’s Hooded Sweatshirts with Drawstrings, imported by Bobens Trading Co. Inc., of Hicksville, New York have been recalled and includes “Old Skool†girls’ hoodie sweatshirts with long and short sleeves in sizes S – XL in a variety of colors and designs. The neck seam label reads “Old Skool†and includes the garment size. The recalled style numbers GC5810, GV105, GV104, and GF254 were printed on the hangtags with the price.
The recalled Bobens hoodies were sold at Burlington Coat Factory stores nationwide from November 2007 to September 2009 from about $8.00 to $20.00. About 2,400 Franshaw Children’s Hooded Jackets, imported by Franshaw Inc., of New York, New York have been recalled and includes Blue Heart and Just a Girl brand children’s sweatshirts. The Blue Heart sweatshirts are olive and pink with style number 48052. The Just a Girl sweatshirts were sold in light blue with style number 48052. RN 87888 is printed in the center of the back neck. The sweatshirts were sold in sizes 4 to 6X exclusively at Burlington Coat Factory stores nationwide from September 2006 through September 2009 for about $10. The garment can be return to Burlington Coat Factory or to Franshaw Inc. for a full refund. Sweatshirts included in this recall have style numbers Q37519, A22090, A393343-3, A79405-226, and A79462-1 and were sold in sizes 2T through 16 at small retail stores nationwide from February 2008 through November 2008 for between $5 and $22. Consumers can return the garment to Weeplay Kids or the place of purchase for a full refund.
