National Law Firm Files 36 Fosamax Femur Fracture Lawsuits

Earlier this month, the national law firm of Parker Waichman LLP filed 36 Fosamax femur fracture lawsuits in the Fosamax side effects mass tort currently underway in New Jersey Superior Court. All of the lawsuits allege that the long-term use of Fosamax caused plaintiffs to suffer painful and debilitating atypical femur fractures.

“We look forward to the start of the first trials in the Fosamax litigation, tentatively scheduled for the fall,” attorney Matthew McCauley said in a statement issued by Parker Waichman LLP. “Parker Waichman LLP is hearing from women on an almost daily basis who sustained life-changing injuries similar to those suffered by our plaintiffs after using Fosamax for years.” As the leading attorney in the Bisphosphonate Litigation Group at Parker Waichman LLP, McCauley is currently investigating Fosamax Actonel and Boniva related femur fractures.

Fosamax and other bisphosphonates are used to treat bone disorders, including osteoporosis in post-menopausal women, and Paget’s disease. In October 2010, the U.S. Food & Drug Administration asked the manufacturers of bisphosphonates used to treat osteoporosis, including Fosamax, to add information to the “Warnings and Precautions” section of the drugs’ labels describing the risk of atypical thigh fractures after a study linked long-term use of such drugs to this side effect.

The three dozen Fosamax femur fracture plaintiffs being represented by Parker Waichman include women from Massachusetts, Mississippi and California. The California Plaintiff used Fosamax from June 2, 2001 through March, 2009, and suffered a right Femur fracture on March 17, 2000. According to her lawsuit, the Mississippi Plaintiff used Fosamax from July 21, 2004 through November 8, 2007. She sustained a left femur fracture on November 8, 2007. The Massachusetts Plaintiff alleges that her use of Fosamax from October 22, 2002 through April, 2011 caused her to suffer two left femur fractures, one on January 28, 2006, and another on April 22, 2011.

These and 33 addition Fosamax lawsuits were filed by Parker Waichman LLP on March 5, in the Superior Court of New Jersey, Law Division, Atlantic County, where lawsuits involving alleged Fosamax side effects have been designated a mass tort (In re: Fosamax Litigation (No. 282 NJ. Super. Ct.). All of the complaints name Merck Sharp & Dohme Corp. f/k/a Merck & Co., Watson Pharmaceuticals, Inc. and Teva Pharmaceuticals USA, Inc. as Defendants, according to the firm.
