Hop-on, Hop-off Bus Tours for New York City Tourists

Each year, more than two million visitors travel to New York City and spend over $100 million to take a guided “hop-on, hop-off” bus tour. These tours take place in large open-topped, double-decker buses that stop at over 40 popular locations around the city, including Times Square, the Empire State Building and the World Trade Center. Consumers who buy tickets can get off the bus at any stops that interest them, and return to the tour on a later bus.

Lawsuit Alleges Monopoly, Artificially Inflated Prices for Consumers

Prior to 2008, Coach USA was in fierce competition with City Sights LLC over the tour bus market. Coach had long dominated the market, but competition from City Sights had the company on edge. Eventually, Coach tired of the competition and in 2008 the companies entered a joint venture, forming Twin America, LLC. The deal split management 50-50 between the companies with the profits shared 60-40 in Coach’s favor. According to Parker Waichman LLP’s class action lawsuit, the joint venture formed by the companies forms a monopoly and violates anti-trust laws. The lawsuit, which names Twin America, LLC, Coach USA, Inc., International Bus Services, Inc., City Sights LLC and City Sights Twin, LLC as Defendants, alleges that the Defendants have formed a monopoly to dominate 99 percent of the market and increase prices by 10 percent.

The class action lawsuit is representing consumers who bought tickets to hop-on, hop-off tour buses in New York City. Among other things, the suit alleges that Twin America made visitors pay artificially inflated prices by dominating the market, violating anti-trust laws.
