Clawfoot supply shower seat injury
The U.S. Consumer Product Safety Commission (CPSC) announced on September 15, 2022, that Clawfoot Supply, LLC, will pay a $6 million civil penalty for failing to report immediately to the CPSC that its Wall-Mounted Teak Folding Shower Seats have a defect that created an unreasonable risk of lacerations and severe injuries to consumers. This settlement agreement settles CPSC’s charge that Clawfoot Supply did not immediately report the hazard to the CPSC as mandated by federal law.
The media announcement from the Consumer Product Safety Commission states that between 2011 and 2018, Clawfoot Supply had received several reports of breakage and corrosion issues with its shower seat. Some of those incident reports said that users were injured after the shower seat failed as they were using the seats. Although Clawfoot Supply was aware of these adverse incident reports concerning their shower seats, the company failed to report these incidents to the CPSC immediately. Clawfoot Supply first reported the incidents with the CPSC in July 2018. Clawfoot Supply issued a recall of its Wall-Mounted Shower Seats on December 04, 2018.
The settlement agreement with the Consumer Product Safety Commission requires Clawfoot Supply to properly maintain a compliance program and have a system of internal procedures and quality controls to make certain that the company is compliant with the federal Consumer Product Safety Act (CPSA). Clawfoot Supply will also file annual reports concerning its compliance program and system of internal controls for the next three years. The Consumer Product Safety Commission provisionally accepted this agreement, but the settlement agreement is subject to public comment.
