When someone is burned, injured, harmed, or killed by a faulty product, the victim or the family of the victim who has passed away as a result of the defective product may have the legal right to file a lawsuit to seek monetary compensation for the harm caused by the defective product. The victim or victim’s family in a wrongful death action will file the suit on the grounds of product liability. In a product liability lawsuit, the plaintiff must establish who is responsible for the harm caused by the defective product and prove that they have a valid claim against those who are liable.
In most cases, the defective product’s manufacturers, distributors, and retailers may be held liable for compensatory damages. Product liability law approves of two types of product liability claims. One type of product liability claim is founded on the defective design. The other kind of product liability claim is based on faulty manufacture.
