Lenovo IdeaPad Class Action Lawsuits. WiFi Issues, Lenovo Reportedly Selling Subpar IdeaPad Ultrabook Tablets and Computers
Reports suggest that the Lenovo IdeaPad U310/U410 has WiFi issues, including limited speed and range. According to a number of users who own the device, the tablet has problems finding wireless internet connection where other similar devices have no issues. If the tablet does manage to get a WiFi connection, its performance seems to be far below what is promised by the manufacturer. Allegedly, download speeds are significantly slower; upload speeds are also slightly slower. According to Ultra Book News, the download/upload for the U310 was measured at 7.81 Mbps/12.72 Mbps compared to 29.25 Mbps/16.79 Mbps seen in the UX21E at the same distance from the router. Out of the box, WiFi is said to be very slow with extremely jumpy download speeds.
A number of consumers have posted on Lenovo’s support forum complaining of subpar WiFi performance. One Canadian user reported in July 2012 that they were unable to use their laptop even once in the six days that they had owned it. Others complain that they are unable to get a connection unless they are sitting directly next to the router. These users and countless others paid for a tablet that was supposed to perform well, but instead they are reportedly left with a defective product that cannot even connect to the internet in a reasonable manner. Lenovo has acknowledged issues with the Lenovo IdeaPads and attempted to correct it but the units with the defective WiFi are still being sold . Lenovo Class Action Allegations, Agreement
Allegations in the ongoing Lenovo class action lawsuit include that Lenovo knowingly sold defective Lenovo Ideapad U310 and U410 “U Series” computers marketed as “ideal for any and all mobile needs.” The lawsuit also indicates that the alleged design defect of the impacted Lenovo products severely limited the ability of the devices to either connect to, or attain, WiFi networks with the speeds and ranges required to engage in mobile computing. According to the lawsuit, this involved violations of a number of acts and laws, including sections of the California Consumers Legal Remedies Act, the Unfair Competition Law, and the District of Columbia Consumer Protection and Procedures. Breach of express warranty and breach of implied warranty of merchantability were also cited.
According to the Class Action Settlement Agreement and Limited Release reached June 2014, plaintiffs and Lenovo reached an agreement to resolve the claims of all consumers who purchased the involved devices. The plaintiffs moved for an order to preliminarily approve the settlement, conditionally certify the class for settlement purposes, appoint class counsel and class representatives, approve the proposed class notice, and set a hearing date for final approval of the settlement. Lenovo filed a notice of non-opposition to the motion and the Court granted the plaintiffs’ motion. The Final Fairness Hearing is scheduled for December 15, 2014.
