To prove your eligibility for the victims compensation fund you have to prove that you were present during 9/11. Specifically the time frame is September 11 2001 to may 30th 2002. There is a specific location that you have to prove you were in which is essentially on Manhattan island, south of Canal street.
There are other locations that could qualify as well like Fresh Kills in Staten Island that was a location where a lot of dust debris and other things were dumped during the cleanup process.
Mainly my office would assist you in approving your presence at that location during the relevant time period. Mainly the way that people do this and really some of the best evidence you could have for this are two affidavits from people who actually saw you down in that area during that time frame.
If you have people to testify that you were there that is a huge help but in situations where this happened nearly 20 years ago, a lot of people have lost contact with former co-workers. A lot of people very tragically lost co-workers in 9/11 or due to the exposure afterwards.
My office has done a lot of work getting very creative on how we actually prove people are down there. Truly you could use anything at these VCF appeal hearings. If you happen to be denied where by the VCF and they say they don’t believe you were down there than my office would appeal it and we could use all sorts of evidence.

What are the benefits and how do you apply for VCF benefits?
The VCF will issue an award if they determine that you were both present and you have a certified condition. The awards can really range from anything to non-cancer condition awards and cancer condition awards.
If you have a non-cancer condition then you’re capped at $90,000 depending on the severity of it and that’s for non-economic damages or your pain and suffering damages.
If you have a 911 cancer claim then you are capped at $250,000 for that cancer related condition for your non-economic loss. Now if you actually have lost wages due to your condition then you can receive up to $200,000 a year in lost wages.
So that is something where it really does help to make someone whole when they’ve been exposed to these conditions and have had these problems due to the 9/11 terrorist attacks.
