The National Highway Traffic Safety Administration (NHTSA) has once again launched its annual “Click It or Ticket” campaign, underscoring the imperative nature of seat belt use. In partnership with several stakeholders, including Colonel Roland Butler Jr., David Mills of the Kailee Mills Foundation, and Dr. Alfred Croteau, a renowned surgeon, the NHTSA introduced a fresh national TV advertisement to advocate for this life-saving cause.
The urgency of this campaign is driven by alarming statistics. For almost two decades, a concerning percentage of fatalities involving pickup trucks were individuals not wearing seat belts — 60% of drivers and 64% of passengers in 2021 alone. But it’s not just pickup truck occupants at risk. A staggering 45% of all passenger vehicle fatalities in 2021 involved individuals not buckled up, amounting to 11,813 lives lost. Notably, nighttime seems to be a particularly perilous time, with 57% of fatalities in such crashes involving individuals without seat belts.
This campaign, set to run until June 4, is not merely an awareness effort. Through a series of digital platforms, social media, radio, and more, NHTSA aims to resonate with a broad audience. Moreover, heightened enforcement will take place between May 22 and June 4, as state and local law enforcement join hands to combat the issue.
At the heart of the NHTSA’s efforts is the understanding that a simple act — taking two seconds to buckle up — can significantly reduce the risk of severe injury or death in the event of a collision. As Chief Counsel Carlson aptly noted, seat belts remain the best defense in accidents, and in most states, wearing them is a legal requirement.
Beyond this campaign, the U.S. Department of Transportation unveiled the National Roadway Safety Strategy in early 2022. This comprehensive strategy endeavors to tackle the broader issue of traffic fatalities and injuries, emphasizing safer roads, safer behaviors, and safer vehicles.
Seeking Legal Recourse in the Event of a Tragedy
When traffic accidents occur, especially those resulting from vehicle defects or third-party negligence, victims and their families typically have the legal right to pursue recourse. A product liability lawsuit can be initiated if a vehicle component, such as a seat belt or airbag, malfunctions. The process begins with filing a claim against the manufacturer or other responsible parties. Such claims can cover damages like medical bills, loss of income, pain and suffering, and, in unfortunate instances, wrongful death.
While the legal system provides a pathway for justice, navigating it is intricate. Engaging a seasoned attorney becomes crucial at every stage — from gathering evidence to negotiating with large corporations and, if needed, representing victims in court. Moreover, an experienced lawyer understands the nuances of product liability, ensuring that victims are justly compensated.
