Second Florida Company Recalls ‘Nuez de la India’ Seeds Citing Potentially Fatal Risks, Says FDA
Consumers rely on labels, dates, and codes to gauge the safety of everyday products like food, medication, and cosmetics. These identifiers become especially crucial when hazardous items need to be swiftly removed from retail.
The OBC Group, a Miami-based enterprise, is the latest company in Florida to recall its “Nut Diet Max Nuez de la India” seeds and capsules. This follows a similar action by Todoorganic last week, both of which were prompted by an FDA alert warning that the seeds may not only be counterfeit but could also be lethal.
The FDA’s cautionary note also included visual evidence contrasting the samples of “Nut Diet Max” seeds with genuine Nuez de la India seeds—also known as candlenut seeds—and yellow oleander. Unlike the authentic candlenut seeds, the recalled products closely resemble yellow oleander, which is highly toxic.
The federal agency advised, “Consumers are urged to discontinue use of any products labeled as Nut Diet Max brand (in seed or capsule form) or Todorganic Natural brand (in seed form) that are marketed as Nuez de la India, India nuts, or India seeds due to possible yellow oleander contamination.” For other similar products, the FDA is encouraging vigilance because of the striking resemblance between harmless candlenut seeds and poisonous yellow oleander seeds.
The FDA’s warning became all the more significant as it was revealed that an individual in Maryland required hospitalization after consuming the Nut Diet Max variant of Nuez de la India seeds. According to the agency, ingesting yellow oleander can result in a range of serious health issues, from neurological and gastrointestinal problems to life-threatening cardiovascular conditions. Symptoms could encompass nausea, vomiting, dizziness, diarrhea, and irregular heart rhythms, among other adverse effects.
What Was Included in the OBC Group’s Recall?
According to public records, The OBC Group, managed by Oscar Becerra in Doral, Florida, has withdrawn its Nut Diet Max Nuez de la India seeds sold on online platforms like Amazon and eBay in 2-ounce bags. The vendors implicated in the FDA’s announcement are EZ Sale Works/AMP Imports in Miami and Rapid Diets in Doral.
In addition, Nut Diet Max capsules, available in 30-count bottles, were sold through Natural Vida in Miami via Walmart and eBay. The recall covers all product lot numbers and expiration dates.
What Should Concerned Customers Do?
Consumers are advised to return any of the implicated seeds or capsules to the place of purchase. The OBC Group’s contact person, Oscar Becerra, is expected to be available for queries at 305-216-1322 from Monday to Friday, between 10 a.m. and 4 p.m. ET. However, attempts to reach him for comment by a Miami Herald reporter were unsuccessful as the voice mailbox had not been set up.
Steps for Filing a Wrongful Death Lawsuit
Losing a loved one is an incredibly emotional and difficult experience. If their death was the result of another person’s negligence or intentional actions, filing a wrongful death lawsuit might be an option to consider. If you’re contemplating this course of action and want to engage Parker Waichman LLP, here’s how you can go about it.
Step 1: Initial Consultation
The first step is usually a consultation to determine if you have a valid wrongful death case. Contact Parker Waichman LLP by phone to receive your free consultation. This meeting serves as an opportunity for both you and the law firm to gauge the strength and particulars of your case.
Step 2: Engagement and Fees
If the law firm believes that you have a strong case, the next step is to officially engage their services. This often involves signing an agreement and discussing fees, which is contingency-based, meaning the law firm would only get paid if you win your case.
Step 3: Gathering Evidence
After engagement, Parker Waichman LLP will begin collecting evidence to substantiate your wrongful death claim. This could include medical records, eyewitness accounts, expert testimonials, and any other relevant data that could strengthen your case.
Step 4: Filing the Lawsuit
Once all the necessary evidence has been collected, your lawyer will file the wrongful death lawsuit on your behalf. This will involve drafting and submitting a complaint to the appropriate court, outlining the allegations against the defendant(s).
Step 5: Pre-trial Proceedings
After the lawsuit is filed, there may be a period of pre-trial discovery where both parties exchange information. Your lawyer will represent you in these procedures, which may include depositions, document requests, and more.
Step 6: Negotiation and Settlement
Many wrongful death cases are resolved through settlements without going to trial. Parker Waichman LLP will negotiate on your behalf to achieve a settlement that adequately compensates for your loss.
Step 7: Going to Trial
If a settlement isn’t reached, the case will go to trial. Parker Waichman LLP will represent you, presenting evidence, examining witnesses, and making arguments to persuade the jury or judge of your case’s merits.
Step 8: Receiving Compensation
If the trial or settlement is successful, the next step is to receive your compensation. Depending on the case, this could include damages for loss of companionship, income, and emotional suffering, among others.
Step 9: Post-trial Matters
Even after receiving compensation, there may be additional legal matters to consider, such as dealing with taxes or dividing the award among family members. Your lawyer will guide you through these final steps.
Filing a wrongful death lawsuit is a complex and emotionally taxing process. However, with the experienced legal team at Parker Waichman LLP, you can navigate the legal maze more easily and focus on healing and honoring the memory of your loved one.
