Why Knee Replacement?

Knee replacement surgery is a common orthopedic procedure that is utilized to relieve pain in patients whose knees have been damaged due to severe injury, debilitating arthritis, or excessive wear and tear.

In fact, the number of knee surgeries individuals are undergoing are on the rise in the United States and are projected to approach 3.5 million procedures per year by 2030. In many instances, patients end up needing knee replacements when other options like medication or orthotics have proved unsuccessful.

The Basics of a Knee Replacement

The knee joint forms where the tibia or shinbone and fibula, which runs next to the tibia, meets with the femur or thighbone. The kneecap or patella, which is located on the front of the knee is supposed to move up and down against the femur. All of these bones are connected by muscles, ligaments, and cartilage that help provide the knee with mobility and stability. When a patient receives an implant, only the tibia, patella, and the femur are impacted. The damaged parts of the knee joint are removed and replaced by a prosthetic implant that is made of plastic, metal, or a combination of the two.

FDA Approval of the Attune Knee System

Depuy Implant Lawyers On Your Side To Help Assist You

DePuy Synthes, a subsidiary of Johnson & Johnson manufactures the Attune Knee Replacement System, and it is considered one of the more popular knee replacement devices that are available on the market. The system is designed to work together with the knee joint and its surrounding muscles, tendons, and ligaments. In 2010, the Food and Drug Administration approved the Attune Knee System, which was thought to increase a patient’s range of motion and stability.

Unfortunately, this DePuy knee replacement device has failed to live up to these expectations and instead, numerous individuals have complained about complications associated with the device, including pain and swelling, loosening of the tibial components, and the need for invasive and painful reconstructive or revision surgeries.

Common Attune Knee Replacement Defect: Tibial Loosening

Many patients who have received a DePuy Attune Knee Replacement have reported that they’ve experienced tibial loosening after their knee replacement surgery. In some instances, the loosening has led to a complete failure of the knee replacement because the bond between the device and the bone falls apart completely. The loosening has been said to occur within the first couple of years after surgery, but others report that it happens in as little as one or two months following surgery.

It is not unusual for patients to be misdiagnosed or not evaluated for tibial loosening. Oftentimes, patients are not diagnosed with loosening right away because when they’re x-rayed, it is difficult or nearly impossible to identify the failed cement bond between the knee component and the bone. This is due in part to the fact that when most x-rays occur, a patient is sitting still, rather than engaging in a walking motion where the way the knee moves might reveal the lack of bond.

Symptoms Associated with a Failed DePuy Attune Knee Replacement

You might be asking, how do know whether my DePuy Attune Knee Replacement has failed? Some of the signs and symptoms associated with an unsuccessful knee replacement include:

Persistent or Constant Pain.

Why Should You Receive A Knee Replacement Implant?

If you are experiencing persistent or constant pain or throbbing while your knee is in motion, it is possible that you might be suffering from a failed knee implant.
Swelling.

If the lining in your knee is inflamed, fluid may build up which can feel like swelling. This can also be an indication that your knee implant is failing.

Heat or Warmth in Your Knee.

Typically, your knee will feel hot or warm for a few months after surgery, but if the sensation returns, it could be that your knee implant has failed.
Loosening or Instability.

If your knee is feeling unstable when you stand up or put weight on it, or if your knee is moving sideways or backward when it wasn’t before, it might be that your implant has failed.

Difficulty Walking.

While initially, it might take some time to get used to using a new implant, if you are having trouble walking after receiving a DePuy Attune Knee Replacement for a lengthy period of time following your surgery, it may be a sign that your implant is failing.

Injuries Associated With a Failed DePuy Attune Knee Replacement

While the symptoms of a failed knee implant are already difficult to deal with, defective knee implants can also lead to other serious injuries, including:

  • Tissue Damage
  • Infection
  • Bone Loss
  • Inflammation
  • Metal Shredding Debris
  • Nerve Damage
  • Bone Fracture

Corrective Surgery to Fix a Failed Knee Implant

Food & Drug Admin. Approval Of The Attune Knee System

In addition, in most cases, the only way to fix a failed implant is to have the patient undergo painful, complex, and invasive corrective surgery. This revision surgery can be particularly complicated when tissue damage or bone loss has already begun to occur.

If the knee implant severely damages the surrounding bone, a patient might need reconstructive surgery. What this means is that the knee requires a complete rebuild before a replacement device can be implanted.

Even if a patient’s corrective or reconstructive surgery is successful and/or effective, it is possible that that patient’s comfort will never be restored fully or that they will ever be able to experience the stability and range of motion they were promised initially.

Possible Complications of Revision or Reconstructive Surgery

Moreover, it is important to note that as with any surgery, there is a risk of complications during a revision or reconstructive surgery, including:

  • Blood Clots
  • Infection in the Wound or New Knee Implant
  • Bone Fracture from Surgery
  • Poor Wound Healing
  • Bleeding
  • Stroke, Heart Attack, or other Complications

DePuy Attune Knee Replacement Claims FAQs

Corrective Surgery Performed To Fix A Failed Knee Implant

Q: What is wrong with the Attune Knee Replacement System?
A: Some patients are reporting system failure which might involve loosening of the tibial plate. This loosening can cause swelling, extreme plain, and potentially other serious complications.

Q: What is the rate of failure with the Attune Knee Replacement System?
A: Most knee replacement systems that are available on the market today are expected to last for up to twenty years. However, some patients who have received the DePuy Attune device have reported failures occurring much sooner. Some patients claim the device failed within a year or two after their initial surgery, but others have reported that it occurred in just a month or two following surgery.

Q: Is there a DePuy Attune Knee Replacement System recall?
A: While there has not been a recall of the DePuy Attune Knee Replacement System, DePuy Synthes has encountered issues with its knee replacement system in the past. Between 2003 and 2013, the company issued a recall on nearly three hundred knee replacement components or devices, which is more than any other knee implant manufacturer. Some of these recalls were labeled as Class I recalls meaning that there was a reasonably probability that using the device would cause serious adverse health consequences or death. Since 2013, the FDA’s database reveals that DePuy has issued at least seven recalls of knee device-related components or surgical tools. However, there isn’t an open recall on the DePuy Attune Knee Replacement System even though complaints made to the Food and Drug Administration have increased.

Q: How can a personal injury lawyer help me?
A: When it comes to personal injury or products liability matters, many cases can be extremely complicated. It is still early in the process for me and I have been kept abreast of matters effecting my case by Jillian, my case manager and Cathy, my paralegal. One aspect of the firm that I had not anticipated was the care and concern shown for my well being by Joanne, the nurse. PARKER WAICHMAN LLC is my law firm and I am glad I contacted them to work on my case. Update: Denny Tang, Esq., handled my case with updates to me throughout the process. He appears genuinely caring about his clients and that quality is priceless. Jillian Cantinieri, Legal Secretary, was initially my go to contact at the firm and performed her duties in a stellar manner. She is an exemplary employee and I am very pleased Jill was assigned to my case.
