BROOKLYN, NY – June 8, 2020 – According to an online news report published on CarComplaints.com, a lawsuit has been filed against Tesla, Inc. alleging Tesla’s Autopilot feature is defective because the system failed to recognize a possible accident between two vehicles adjacent to the Tesla, and did not initiate the automatic emergency braking device.

The accident occurred on December 17, 2017. The New York driver claims he was driving the Tesla Model X eastbound along the far-right traffic lane on the Long Island Expressway. The Tesla driver claims that he engaged the car’s Autosteer and Traffic-Aware Cruise Control features. He stated that he also set the following distance to “3.” According to the report, the driver was following a tractor-trailer truck in traffic, and an Audi attempted to merge between his Tesla and the tractor-trailer truck in front of him. The complaint alleges that the Tesla Model X decelerated due to the speed of the tractor-trailer truck in front of the Tesla, and not because of the merging Audi. The lawsuit also alleges that the Tesla suddenly sped up toward the merging Audi as if the Tesla failed to recognize the merging Audi or the Tesla system didn’t see the Audi at all. The Tesla owner stated that the Tesla system also did not warn him of the potential accident, and the two vehicles hit each other before coming to a stop.

The news story reports that Tesla is insisting that it’s Model X Autosteer features, along with its Traffic-Aware Cruise Control functioned properly. Tesla states that these systems are designed to disengage when the speed of the Model X falls below a specified speed as noted in the Model X’s owner’s manual. Also, Tesla asserted that the Model X’s owner’s manual explains to drivers that they must remain alert and drivers of the Model X should never rely solely on the vehicle’s Autopilot to decelerate or steer the automobile.

This Tesla Model X Autosteering accident lawsuit has been filed in the U.S. District Court for the Southern District of New York.
