Tasigna Injury Lawsuits
On August 10, 2021, Parker Waichman LLP won a critical argument on behalf of plaintiffs who filed lawsuits alleging Tasigna® (Nilotinib) caused severe harm, including peripheral vascular disease, arterial damage necessitating surgical amputation of limbs, cardiovascular disease, arteriosclerosis, and/or other injuries. Trial attorney Chris Oxx of Parker Waichman successfully argued that all pending Tasigna cases should be consolidated. In contrast, global giant Novartis argued that there were not enough Tasigna lawsuits to justify the move.
Attorney Chris Oxx, who represents the victims purportedly harmed by the cancer drug, stated that consolidating the cases will enable the court to coordinate with the New Jersey court to uniformly and efficiently and resolve disagreements in all Tasigna cases. The Judicial Panel on Multidistrict Litigation issued a court order that centralized the Middle District of Florida cases, thereby rejecting Novartis’ argument to rule against the plaintiffs and litigation centralization.
According to the judicial panel, “The prospect for informally coordinating so many actions with differing schedules before so many different judges seems labor-intensive and inefficient.” Moreover, the panel stated that the cases are to remain in a Florida federal court since there are more cases pending than in any other district. The panel said that the Middle District of Florida is a convenient and readily accessible district that is underutilized.
Additional Tasigna Injury Lawsuits Are Anticipated
A Tasigna lawsuit alleges that Novartis, the manufacturer of Tasigna, failed to adequately warn the public about the potential side effects and health risks associated with Tasigna. Tasigna has been shown to cause the hardening and narrowing of arteries in many patients prescribed the blood cancer medication. One lawsuit filed in March of 2020 claims a Tasigna user took the medication for three years, and as a result of taking the drug, the patient suffered peripheral vascular disease, ultimately leading to multiple surgical operations and limb amputation.
Parker Waichman LLP maintains that more victims will seek monetary compensation for harm caused by Tasigna and will have their claim reviewed by their Tasigna injury attorneys.
