The Consumer Product Safety Commission (CPSC) is the focal point of a lawsuit filed by a grieving family whose child died while sleeping in a Fisher-Price Rock ‘n Play chair. The suit criticized the CPSC for failing to act quickly and decisively when reviewed consumer complaints and reports about dangerous products circulating the commerce across the United States, specifically the Rock ‘n Play. Consumer advocates say the agency is lax in its pursuit of eliminating dangerous products from the marketplace and failing to fight to hold companies liable for the harm they caused.
Parker Waichman LLP is a nationally renowned plaintiffs’ law firm whose attorneys are aggressive advocates for people injured or killed by defective products in the marketplace. Parker Waichman LLP’s products liability and injury lawyers have a tremendous track record of success holding large, international corporations liable for hurt and loss they have caused average people who have faith that the manufacturers of consumer goods produce safety products. Unfortunately, corporations manufacturing consumer goods betray the trust consumers put in them by selling defective products.
When federal agencies like the CPSC refuse to take action against major corporate entities to prevent further tragedy caused by defective products, Parker Waichman LLP’s products liability lawyers will join the fight on behalf of their injured clients and vigorously pursue justice for them. Parker Waichman LLP’s products liability lawyers have the knowledge, skill, and the resources to square off against massive companies like Fisher Price and their legions of high-priced attorneys who want nothing more than to vindicate their client’s greediness. Parker Waichman LLP’s attorneys level the playing field for the injured consumer so that justice may be done.
The CPSC was designed to be an agency that watches over the consuming public and protect average people from falling prey to faulty consumer goods. Somewhere along the line in their mission, the CPSC has failed the public miserably. The CPSC received information concerning 30 fatalities and over 700 injuries reported since 2005 caused by inclined sleepers like Fisher Price’s Rock ‘n Play. The inclined position helps a restless baby relax and find sleep quickly. Fisher Price maintains that these items are safe. However, out of the 30 children who died in them, 16 of the children died since September of 2016.
Heartbroken parents argue that the CPSC response to these complaints is wholly inadequate. The CPSC has only issued educational bulletins to parents designed to teach them how to use the Rock ‘n Play safety. In 2017, the CPSC also proposed a rule under its rulemaking authority that mandated manufacturers take action that they already voluntarily take. Furthermore, the CPSC released another parental alert in May of 2018 that essentially parroted its earlier alerts.
The American Academy of Pediatrics (AAP) roundly criticizes these actions and called upon the CPSC to do more. AAP members agree that the CPSC must change manufacturing requirements to lower the angle of the sleeper and that only issuing consumer alerts misses the mark. A consumer agency operating in the state of Michigan has previously declared that these items in question are not safe. Additionally, regulations in Canada prohibit an angle greater than 7-degrees in sleepers. By contrast, the items sold in the U.S. have a 30-degree angle. AAP members suggest that a higher angle makes breathing more difficult for the baby and can become trapped in fabric that can suffocate the child. Legislators have also voiced their concerns and called for the CPSC to act swiftly and apply pressure on defective consumer product manufacturers, especially Fisher Price, to eliminate the dangers found in their products.
