A class action lawsuit has been filed against KAS Direct LLC d/b/a Babyganics alleging that the company’s baby products are not actually organic. Plaintiffs allege that the products are falsely represented and alleges that Babyganics engaged in unlawful, unfair, deceptive and misleading business practices involving the sale of its products. Babyganics offers a number of baby products including sunscreen, lotion, shampoo, body wash, rash cream, toothpaste, baby wipes, dish soap and laundry detergent.
The plaintiffs in the class action allege that Babyganics misled consumers into thinking their products are organic. Allegedly, the company chose the name “Babyganics” in order to give this impression. The plaintiffs also allege that the products are “replete with statements” assuring parents that the products are organic.
In particular, the plaintiffs say Babyganics misrepresented its “mineral sunscreen” as organic. The class action states that Babyganics is labeled as “mineral-based”. Plaintiffs allege that the product is a combination of mineral and chemical sunscreens. “In fact, these Sunscreens are not mineral sunscreens, which use physical sunscreens such as Titanium Dioxide and Zinc Oxide that sit on top of the skin to deflect and scatter UV rays away from the skin,” the class action complaint states. “Instead, Defendant’s ‘mineral-based’ sunscreens use a combination of physical sunscreens and chemical sunscreens, which penetrate the skin and absorb UV radiation,” The suit alleges that Babyganics sunscreen contains chemicals such as octinoxate and octisalate.
The deceptive marketing class action lawsuit also alleges that Babyganics misrepresented other products. Plaintiffs state that the marketing materials indicate the products are organic, but actually contain synthetic ingredients that are not organic.
Plaintiffs allege that they chose Babyganics under the premise that its products are organic and/or mineral-based. They further allege that they would not have paid extra for products are not truly organic or mineral-based. The plaintiff class represents individuals who purchased Babyganics products anywhere in the United States.
