A woman from Florida is suing an eye drop manufacturer, alleging that its product, which has been associated with a fatal bacterial outbreak, caused her to become legally blind. The 68 years old Plaintiff is pursuing legal action against Global Pharma Healthcare after experiencing such a severe infection from using its EzriCare Artificial Tears that her eye had to be removed, as indicated in court documents.
To manage a “serious antibiotic-resistant infection,” Plaintiff’s right eye was taken out and replaced with a plastic implant in September 2022, according to the lawsuit filed earlier this month in a Federal court in Miami, Florida.
“With her remaining left eye’s reduced visual acuity of 20/200, she is now legally blind,” the complaint added.
Plaintiff is among approximately 70 individuals in sixteen U.S. states who have been infected with a rare, extensively drug-resistant strain of Pseudomonas aeruginosa bacteria. The Center for Disease Control and Prevention (CDC) has connected this germ to EzriCare Artificial Tears.
The CDC’s data reveals that three people have tragically died, eight others have lost their vision, and four others, including Plaintiff, have had an eyeball removed due to the infection’s severity.
In response to the multi-state outbreak, Global Pharma recalled all batches of its EzriCare & Delsam Pharma artificial tears and Delsam Pharma’s Artificial Eye Ointment last month, citing possible bacterial contamination.
The lawsuit states that Plaintiff began using the now-recalled product in May 2022 after her insurance provider changed the authorized eye drops. By August, her right eye was “visibly red, swollen, and excessively watery,” as per the lawsuit.
The prescribed medication was ineffective, and her vision continued to decline, according to the lawsuit.
Allegedly, her eye’s chronic pain and deteriorating vision persisted throughout the month, even as her medications were adjusted.
Eventually, tests revealed “moderate growth of pseudomonas aeruginosa,” as mentioned in the lawsuit.
The lawsuit states that “despite aggressive medical treatment, the pain in her right eye continued to intensify, her visual acuity worsened, and the corneal ulcer expanded.” “The medical team adjusted her medications, but none of the attempted treatments were effective.”
Due to the infection’s severity, “the depletion of treatment options, and the risk of the infection spreading systemically, creating a life-threatening situation,” healthcare professionals determined that removing her eye was the best course of action.
