Tasigna Atherosclerosis Compensation. The cancer drug Tasigna can cause a severe medical condition known as atherosclerosis, which can lead to life-threatening complications. The attorneys at Parker Waichman LLP are filing lawsuits against the manufacturer of Tasigna on behalf of men and women affected by atherosclerosis and are seeking significant compensation for their injuries. Tasigna Causes Arterial Diseases and Serious Complications in Cancer Patients

Tasigna is manufactured by Novartis Pharma Stein AG and Novartis Pharmaceuticals Corporation and is part of a class of drugs called kinase inhibitors. It was designed to treat of a specific cancer of the blood and bone marrow known as chronic phase and accelerated phase Philadelphia chromosome-positive chronic myelogenous leukemia (Ph+ CML). Patients with this cancer possess an abnormal chromosome (the Philadelphia chromosome) that uncontrollably produces white blood cells. Tasigna is supposed to help patients with Ph+ CML by blocking the Philadelphia chromosome to prevent it from producing so many white blood cells.

Studies indicate that Tasigna can cause a condition known as atherosclerosis, in which your arteries become thickened or blocked by plaque. The arterial blockage prevents proper blood flow in your body and can lead to serious diseases and additional complications, including:

  • Heart attack
  • Stroke
  • Infections
  • Tissue decay
  • Amputations
  • Kidney failure
  • Death

In 2013, the Canadian drug administration (Health Canada) released a warning related to an association between Tasigna and atherosclerosis-related diseases, and it required Novartis to change its Tasigna drug label to include warnings about the risk of atherosclerosis. To date, Novartis has not made any such changes to its Tasigna label in the United States.

Parker Waichman is pursuing litigation against Novartis for failing to warn patients and doctors in the United States about the risk of developing atherosclerosis and for distributing Tasigna in an unreasonably unsafe condition.

Do I Need an Attorney?

We always tell potential clients that they need an attorney to ensure the best chances of recovery. It is never a good idea to try to litigate your case by yourself. Even if you have some knowledge of the law or court systems, drug product cases are extremely complicated. Keep in mind, in a Tasigna case; you are suing a pharmaceutical giant with seemingly unending resources. You need to work with a firm that can effectively compete with Novartis’ corporate counsel.

Your attorney will need to perform numerous tasks to prepare your case for filing, including:

  • Creating a summary detailing your cancer diagnoses and treatment;
  • Obtaining your pharmacy records showing that you took brand-name Tasigna (something we refer to as obtaining “proof of use”);
  • Ordering medical records showing your cancer treatments, prescribing notes, and treatment for atherosclerosis and/or other related diseases;
  • Hiring experts to review your records and evaluate the viability of your claims;
  • Calculating the statute of limitations or filing deadline for your claims;
  • Determining the correct location and court for filing your claim;
  • Drafting a complaint and filing on your behalf in court.

These tasks only get you to the filing, after which your attorney will engage in discovery and depositions and, in some cases, enter into settlement negotiations with the defense. Litigation takes considerable time and expense, and it is simply not worth the risk of trying to do alone or trying to carry out with an inexperienced attorney. To provide yourself the greatest opportunities for recovery, you need to work with the best lawyers.

Finding the Right Attorney for Your Case

It can be difficult to know which attorney to hire when so many firms come up with a simple online search. It is essential that you do adequate research on the firms you’re interested in hiring and that you contact each firm to ask questions. If you ask some of the following questions, you should gain an idea of whether any firm is qualified to take your case:

  1. Are you working on any other Tasigna cases?
  2. Are you familiar with the regulation and marketing history of Tasigna?
  3. Are you able to work on out-of-state cases?
  4. How many attorneys and staff members in your office work on mass torts?
  5. How much of your practice involves product liability litigation?
  6. Are you familiar with the current litigation status of Tasigna?
  7. Do you require a retainer for legal services?
  8. Do you use contingency fee contracts?

The firm’s answers to these questions will help you understand its potential for taking on a complex drug product case like yours. If you feel the firm sounds inexperienced or is lacking knowledge about the Tasigna litigation, you should make a concerted effort to find a firm that would be better equipped to represent you.

They were very helpful & extremely patient with my non-stop requests for clarification regarding certain things that I didn’t understand. The majority of my interactions were with Ashley & she was absolutely wonderful. She was knowledgeable, pleasant & always made it clear that I wasn’t a burden when I was asking her to once again explain something to me that she had already done at least one time in the past.

Parker Waichman was extremely professional and helpful in handling our WTC case. Benita Rollis, in particular, was amazing in helping us complete all the necessary steps and paper work for our claim. She was always quick to return phone calls and reach out to keep us posted on how things were progressing. Not only was Benita efficient and professional, she was also very compassionate in helping us through the emotional side of this long process. Carolyn Corcoran & Family
