Yasmin Blood Clot Injury Lawsuits. Momentum appears to be building to settle the vast majority of Yaz and Yasmin lawsuits pending throughout the U.S. According to a report from The Madison Record, more than 1,500 Yaz and Yasmin lawsuits alleging the birth control bills caused serious blood clots have been settled in a federal multidistrict litigation in which more than 9,000 such claims are pending. Settlements are also being reported in state litigations underway in Pennsylvania and New Jersey.
Stephen Saltzburg, the George Washington law professor appointed by U.S. District Judge David Herndon to mediate settlement negotiations in the federal Yaz and Yasmin litigation underway in the Southern District of Missouri, told the Record that he was optimistic most cases would settle within the year.
Saltzburg, who is also overseeing settlement talks in the Pennsylvania and New Jersey litigations, added that “everyone wants their cases settled,” and that the judges overseeing the litigations “are very happy that these cases are settling in the way they are settling.”
So far, Satlzburg says Bayer, the maker of Yaz and Yasmin, has agreed to spend $300 million to resolve the cases settled so far. Most involve claims that Yaz and Yasmin caused plaintiffs to suffer deep vein thrombosis or pulmonary embolism.
The average settlement comes to about $214,000, with plaintiffs who have the most serious claims being awarded the highest amounts
“So far, so good,” Salzburg told the record, according to the Record. “I am cautiously optimistic that we will settle all of these cases. There are always some holdouts, but I think we will settle the bulk of these cases in the next year.”
