Church & Dwight, the parent organization of Batiste, has reached an agreement to resolve a $2.5 million class-action lawsuit alleging that its dry shampoo products contain benzene, a chemical associated with cancer risk in humans.

If you’ve bought one or more Batiste dry shampoo products, you might be eligible to receive a share of the million-dollar legal settlement.

The plaintiffs in the case argued that Batiste dry shampoos were tainted with benzene, a chemical proven to be a human carcinogen linked to leukemia and other blood cancers. Although Church & Dwight has refuted these allegations and insists it hasn’t acted improperly, the company has consented to finalize the $2.5 million settlement to sidestep the financial and attentional burdens of prolonging the litigation.

This lawsuit against Batiste follows a similar incident involving Unilever, the manufacturer of Dove, Suave, and TRESemmé, almost a year ago. Unilever recalled 19 aerosol dry shampoo products due to “potentially elevated levels” of benzene. Subsequent internal research traced the benzene to the propellants used in the aerosol cans. Despite this, Unilever asserted that daily exposure to benzene levels in their products would not pose significant health risks.

The Centers for Disease Control and Prevention (CDC) states that benzene naturally occurs in environments like crude oil and gasoline and is utilized in the production of plastics, dyes, lubricants, and detergents. Benzene is also present in low concentrations in both indoor and outdoor air, emanating from sources like tobacco smoke, vehicle exhaust, industrial output, and household paints.

Extended exposure to benzene mainly impacts the blood, potentially causing a decrease in red blood cell counts or anemia after a year or more of exposure to elevated benzene levels. The Department of Health and Human Services (DHHS) confirms that benzene can lead to blood-related cancers, such as leukemia.

Last year, independent lab Valisure revealed that 70% of samples from 34 Unilever dry shampoo brands had detectable levels of benzene. Finding elevated benzene levels in dry shampoos is a significant concern, especially as these products are often used indoors, where benzene may accumulate and be inhaled for extended periods, according to David Light, CEO of Valisure. Light added that these discoveries, along with other findings by Valisure, like benzene presence in body sprays, hand sanitizers, and sunscreens, emphasize the critical need for independent product testing. This is especially true given the intricacies and vulnerabilities of today’s global supply chain.

Why File A Batiste Shampoo Cancer Lawsuit?

Filing a lawsuit against Batiste Shampoo for its alleged link to cancer could be considered for several reasons, although it’s important to consult with qualified legal and medical professionals for personalized advice. Here are some reasons one might consider:

Health Concerns: The foremost concern is the health and well-being of consumers. If Batiste Shampoo is found to contain benzene—a known human carcinogen linked to leukemia and other blood-related cancers—it would be a major public health issue. Filing a lawsuit could help draw attention to the problem and motivate corrective action.

Financial Compensation: People who have been adversely affected could potentially receive compensation for medical costs, loss of earnings, and emotional suffering, among other things. In the case of a class-action lawsuit, many individuals who have purchased Batiste products may be eligible for a share of the settlement, which in the current instance was $2.5 million.

Holding Companies Accountable: Filing a lawsuit can hold companies like Church & Dwight accountable for their products. Even if the company denies wrongdoing, agreeing to a settlement can act as a deterrent against future negligent behavior, encouraging more rigorous product testing and quality control.

Legal Precedent: Successfully filing a lawsuit can set a legal precedent that encourages other companies to be more cautious about product safety, helping to protect consumers in the long run.

Public Awareness: A lawsuit can help increase public awareness about potentially harmful substances in everyday products, encouraging consumers to be more vigilant and informed about what they purchase and use.

Regulatory Change: A lawsuit and its subsequent media coverage can prompt regulatory agencies to take a closer look at not only the company in question but also the broader industry. This could lead to stricter regulations and guidelines that protect consumers.

Inducing Corporate Transparency: Filing a lawsuit could compel the company to be more transparent about its product ingredients, manufacturing processes, and quality control measures, thus providing consumers with better information.

Moral and Ethical Reasons: Some may feel a moral or ethical obligation to file a lawsuit, particularly if they or a loved one have been directly affected. The act of filing can serve as a form of advocacy for consumer rights and public health.
