I am a Partner at the law firm Parker Waichman LLP in New York. I started as an Associate at the firm in August 2004 and became a Partner in January 2011. I have been a member of the Bar of the State of New York since April 2000 and am admitted to practice in the United States District Courts for the Southern, Eastern, Western, and Northern Districts of New York. I have been admitted pro hac vice in numerous federal and state courts throughout the United States in complex litigation matters involving serious injuries sustained by individuals as a result of their use of pharmaceuticals, medical devices, and consumer products.
I have spent the entirety of my twenty-one years as an attorney protecting the rights of individuals who have been injured as a result of the negligence of others. For the first twelve years of my practice, I exclusively handled general negligence, medical malpractice and products liability litigation, primarily in New York State courts, often involving significant and life-changing injuries. For the past decade, I have specifically focused my practice on the representation of plaintiffs in multidistrict and complex litigation matters. In my capacity as a Partner of the firm, I am responsible for managing multiple litigations involving thousands of clients. This includes supervising a team of attorneys and other professionals in every aspect of the litigations, from inception through resolution. In this role, I have had the opportunity to undertake virtually every task necessary in matters of complex litigation.
During my career, I have served as lead trial counsel in a medical device case against a major device manufacturer; been an integral member of the trial team in a case against a major pharmaceutical manufacturer; taken the depositions of numerous, high level corporate representatives in the fields of regulatory, clinical, preclinical, statistics, epidemiology, sales and marketing with major pharmaceutical and medical device companies, both overseas and domestically; handled the development of experts from around the world in nearly every discipline, from retention through the production of expert reports and deposition/trial testimony; and taken the depositions of designated defense experts in numerous and varied disciplines ranging from orthopedics and obstetrics/gynecology to biostatistics and epidemiology. I have also worked with implanting surgeons, prescribing doctors, and treating physicians in pharmaceutical, medical device, and consumer product cases and prepared, defended, and/or taken their depositions and trial testimony. Lastly, I have handled the depositions of many plaintiffs in these same cases including preparing them for and defending their depositions.
My personal MDL/Coordinated Mass Tort Proceeding experience includes my Co-Lead Counsel position in In Re: Mirena IUD Products Liability Litigation (Case No. 297, Superior Court, Bergen County, Rachelle L. Harz, J.S.C.), involving hundreds of women who brought suit against Bayer Pharmaceuticals alleging injuries sustained as a result of their use of a levonorgestrel containing intra-uterine device for contraception. This litigation is now concluded. Currently, I am serving as Co-Lead Counsel in In Re Tasigna Products Liability Litigation, MDL 3006 (U.S. District Court, Middle District of Florida, Hon. Roy B. Dalton), as a member of the Plaintiffs’ Steering Committee in In Re: Davol/C.R. Bard Hernia Mesh Multi-Case Management (Master Docket No. PC-2018-999, Superior Court, State of Rhode Island) and as a member of Plaintiffs’ Executive Committee in In re: Uloric Products Liability Coordinated Pretrial Proceedings (Case No. 20 C 623, U.S. District Court, District of Northern Illinois, Hon. Matthew F. Kennelly).
My overall experience in these types of proceedings, however, goes beyond any official leadership title granted to me by a presiding court. I have also worked extensively on the science, discovery, and trial teams in In Re: Denture Cream Products Liability Litigation (MDL No. 2051), In Re: Actos (Pioglitazone) Products Liability Litigation (MDL No. 2299), In Re: Fosamax Litigation (Case No. 282, Superior Court, Middlesex County, James F. Hyland, J.S.C.), In Re: Mirena IUS Levonogestrel-Related Products Liability Litigation (No. II) (MDL No. 2767), and In Re: Elmiron (Pentosan Polysulfate Sodium) Products Liability Litigation (MDL 2973).
I was also a member of the trial team in the matter of Beare v. Johnson v. Johnson, et al., Docket No. ATL-L-196-10, Superior Court, Atlantic County, a product liability case involving the drug Levaquin®, which was tried to a verdict before the Honorable Carol Higbee in the Fall of 2011. My role during this trial included developing our trial strategy, preparing witnesses, including expert witnesses, for their trial testimony, and conducting the direct and cross examinations of witnesses during the trial. I was also lead counsel in the matter of Maria Stone, et al. v. Ethicon Incorporated, et al., Docket Number: 2:12-cv-00274-ROS, U.S. District Court, District of Arizona, a product liability case involving transvaginal mesh, which was tried before the Honorable Roslyn O. Silver in the Summer of 2017.
