Monsanto, one of the world’s largest and most powerful chemical companies, continues to deny that its popular weed-killer Roundup has an active ingredient linked to cancer. The debate rages on over whether the active ingredient, glyphosate, can cause cancer. Many health agencies in Europe have banned the use and sale of Roundup in their respective countries. Environmental and health agencies in the United States can’t reach a clear consensus. What does that mean for people who have used Roundup for their whole lives and are now suffering from cancer? It means that those who have developed cancer may be eligible to file a claim in court seeking damages for Monsanto’s careless and reckless behavior.

Monsanto has a duty to warn its customers that using Roundup for a long time could cause you to get very sick. Monsanto knew as far back as 2003 that one of its best-selling products, Roundup, contains a potent chemical that can cause cancer. Instead of coming out and confronting the issues, they buried their findings. A toxicologist employed by Monsanto discussed in an email exchange that the company’s worries had finally come true: that studies conducted by health agencies began to conclude that glyphosate exposure causes cancer.
Through discovery conducted in the multi-district litigation (MDL) which is pending in the federal district court located in San Francisco and in class action cases pending in courts around the country, the plaintiffs learned that Monsanto knew, or should have known, that their products might be carcinogenic. Monsanto fought long and hard to prevent disclosure of those materials. However, judges ordered Monsanto to turn the documents over to the plaintiffs’ attorneys.
Analysis of some 2,000 pages of documents the court ordered turned over shows that the company engaged in “ghostwriting” some of the studies upon which they relied to deny glyphosate was carcinogenic. Monsanto even went so far as to create the study groups and funded those groups while giving them names that appear to be legitimate scientific workgroups. This is a similar game to that which the tobacco industry played when victims began suing them and seeking internal documents through a court-supervised process called “discovery.”
According to recent figures compiled, 300 lawsuits are pending in the Roundup MDL brought by the individuals who fell sick or their loved ones. Furthermore, one recent estimate shows another 3,500 additional plaintiffs from the cases which were not consolidated into the MDL.
Those plaintiffs have lived a life tied to the soil and growing food for others to eat. For example, numerous farmers filed a class action suit in Nebraska seeking damages after contracting non-Hodgkin lymphoma linked to Roundup. The farmers used the commercial version of Roundup for dozens of years, believing what Monsanto told them: the product was safe. Other plaintiffs include home gardeners and commercial landscapers who have repeatedly used Roundup to combat weeds.
At least one study concluded that glyphosate could cause breast cancer. The study showed that the chemical could make breast cancer cells grow. The root of the cause may be found in the estrogen receptors of the breast tissue. Glyphosate influenced cancerous cell growth in breast cancer that was present in “human hormone-dependent breast cancer,” with estrogen being the hormone upon which growth was dependent.
Glyphosate increases the rate at which cancer cells grow and divide. Therefore, exposure to the active ingredient in Roundup, whether from inhaling the aerosol or eating foods covered by the herbicide, will cause cancer to spread.
Breast cancer, as most people know, is lethal. Approximately 41,000 people will die this year from breast cancer, with men comprising about 1,000 of those victims. An astounding 300,000 people received a breast cancer diagnosis in 2018. The survival rate is high if doctors catch cancer early enough to treat it. However, the mortality rate of breast cancer is very high once the diseased cells metastasize to other organs and bones.
Monsanto vigorously disputes the findings of the European health agencies who determined that a link exists between Roundup and cancer. Additionally, the company filed a lawsuit on its behalf against the State of California after California’s Environmental Protection Agency warning that Roundup can cause cancer. Monsanto claims that California’s “erroneous” labeling of glyphosate has ruined the company’s reputation and caused it to lose a substantial amount of money invested in genetically modified crops. Monsanto calls these findings “unscientific.”
Monsanto may have found a friend at home in the U.S., the Federal Environmental Protection Agency (EPA) claims that glyphosate likely does not cause cancer. That finding directly contradicts Monsanto’s internal concerns, the State of California, and European health agencies.
Based off of previous settlements, plaintiffs received an average gross of $160,000 for their Roundup cancer lawsuit settlements. The settlement for an individual will vary depending on the scope of their damages and their individual circumstances.
