GAF TruSlate Damage Claims

In one lawsuit brought against GAF, the homeowners allege that they were never made aware of the product line warranty until after they reported roof failure. The homeowners also allege that, almost immediately following installation of the TruSlate roof, the roofing components began to deteriorate and dislodge. Ultimately, following home inspections and examinations, the homeowners were told to allow the TruSlate time to settle and GAF represented to the homeowners following inspections of their allegedly defective roof, that no problems or concerns existed with the roof’s installation.

Since the summer of 2011, the homeowners’ TruSlate roofing components have deteriorated and tiles have fallen, broken, and have become dislodged on an ongoing basis, according to the lawsuit’s allegations. The homeowners also allege that, although GAF is aware of the problem, it did not remedy or replace the defective TruSlate tiles.

Since installation of this homeowner’s TruSlate tiles, GAF ceased making and selling the “Sunset” shade of TruSlate that was installed on the homeowners’ roof and GAF did not advise the homeowners of this matter until the summer of 2014, according to the allegations; Sunset was discontinued in 2011. The homeowners also claim that, because of this, they have no repair or replacement options for the parts of the roof that have deteriorated.

Meanwhile in June 2013, GAF asked the homeowners to contact a third-party firm to inspect the roof and prepare a repair/replacement proposal. That proposal indicates that, as of the time of the inspection, the labor cost to replace the damaged roof, excluding the cost of new materials, would be $83,000. In 2014, the builders prepared an updated proposal for labor costs to repair the roof, which indicated a dramatic cost increase. Allegations include that the roof is incomplete, is unsightly, is unable to be repaired, causes ongoing danger to people and property near this property, has caused a significant evaluation of the property, violates the Magnuson-Moss Warrant Act, and will lead to removal and replacement costs exceeding $200,000.

GAF TruSlate Marketing

In its marketing of the TruSlate roofing tiles, GAF indicated that not only would installation of the TruSlate improve home resale values, TruSlate “may even help you to sell ”your home “more quickly.”

According to the GAF website, “On a traditionally installed slate roof, half of each slate is never seen, because it’s tucked under the piece above it. We’ve replaced this wasted slate with a high-tech waterproofing material. With this ingenious design, the TruSlate® System can be installed on almost any roof.” The GAF website also indicates that, “The unique hanger system and UV moisture barrier provide protection for the roof during all types of weather.”

In at least one case, a consumer reported tiles blowing off the roof, even causing damage to neighboring property. Complaints involve reports of premature damage in less than one year after the TruSlate tiles were installed.

GAF Lawsuits Continue to Mount

Claims include negligence, breach of warranties, and misrepresentation as well as violations of the Magnuson-Moss Warranty Act (the federal statute that governs warranties on consumer products); breach of implied warranty—failure of essential purpose; violations of Ohio Consumer Sales Practices Act (OCSPA); fraud; negligent misrepresentation; and unjust enrichment.
